PORTBYHAN HOTEL LOCALS DISCOUNT CARD TERMS & CONDITIONS
These Terms and Conditions (the “Terms”) set out the basis on which you can use your Locals Discount Card (the “Discount Card”). Please read them carefully as they contain important information. By signing up to a Discount Card you are confirming that you have read, understood and agreed to these Terms. These Terms will always be readily available on the Portbyhan Hotel’s website but Discount Card holders are also welcome to keep a print out of the below terms for their own reference.
These Terms are in respect of your use of the Discount Card only. The terms and conditions in respect of our supply of products to you are contained here.
GENERAL
1.1 These Terms apply to the Discount Card provided to you by Edwards Hotels Limited T/A The Portbyhan Hotel and govern the relationship between Edwards Hotels Limited T/A The Portbyhan Hotel (“we” or “us”) and members of the Discount Card scheme (“you” or “your”) run by Edwards Hotels Limited T/A The Portbyhan Hotel in respect of the Discount Card.
1.2 The promoter of the Discount Card is Edwards Hotels Limited T/A The Portbyhan Hotel, The Courtyard Parc Business Edwards, Llantrisant, Pontyclun, Wales, CF72 8QZ company number 08482947, VAT registration number GB162214149 and, for the purposes of these Terms, Edwards Hotels Limited T/A The Portbyhan Hotel will be referred to “Portbyhan Hotel”.
1.3 It is within the discretion of the Portbyhan Hotel that certain products may be excluded from the Discount Card scheme. In such circumstance, details of such excluded products will be available at the Portbyhan Hotel.
1.4 By using the Discount Card you indicate that you accept these Terms and that you agree to be bound by them. If you do not agree to be bound by these Terms, you may not use your Discount Card. If there is anything you do not understand, please contact the Portbyhan Hotel either by email at stay@portbyhan.com or by phone on 01503 262071.
1.5 The Portbyhan Hotel reserve the right to change these Terms from time to time. Any such changes will take effect when posted on portbyhan.com and your continued use of the Discount Card shall constitute your acceptance to be bound by the latest Terms.
1.6 The construction, validity and performance of these Terms are governed by English law and you can bring legal proceedings in connection with these Terms exclusively in the English courts.
PORTBYHAN HOTEL DISCOUNT CARDS
2.1 Discount Cards can be collected at the Portbyhan Hotel.
2.2 When you receive your Discount Card, you will get access to the Discount Card price as well as exclusive offers and special promotions. Some offers will only be promoted to customers who have opted in for email and / or postal marketing communications from the Portbyhan Hotel. Some Discount Card offers cannot to be used in conjunction with certain Sales, Offers, days of the week or other offers and cannot be redeemed against purchasing gift vouchers. Where the Discount Card cannot be used in conjunction with Excluded Purchases this will be stated on our website or at the Portbyhan Hotel, as applicable.
2.3. In order to qualify for a Discount Card, you must provide your name, address and contact details. See clause 5 for details of how this information will be used.
2.4 If you need to change any of the details you have registered with your Discount Card, please notify us of the changes you require at stay@portbyhan.com. Please note that it is your responsibility to notify us of any changes to your details.
2.5 A Discount Card can only be registered in the name of an individual who is over the age of 18 at the time of registration. If the individual is not a UK resident, then a valid email address must be provided.
2.6 Only one Discount Card can be registered per individual. Individuals residing in the same address can use the same Discount Card with the card holders’ authorization.
2.7 It is the responsibility for any persons holding a discount card to advise if there is a change of address change and provide relevant documentation as per clause 2.4.
2.8 To obtain your discount on purchases, you should present your Discount Card at the point of purchase. If you do not have your Discount Card, you must provide full details of the card holder. If you do not present the physical Discount Card and/or correct card holder details before you make payment, you will have to pay the full marked retail price.
2.9 Once received in accordance with clause 2.1–2.8, a Discount Card: 2.9.1 cannot be used as a credit card, debit card or a cheque
guarantee card;
2.9.2 cannot be resold, transferred, exchanged for cash or traded
by you;
2.9.3 cannot be used in conjunction with staff discount, affiliate or organisational discounts.
2.13 The discount card is redeemable against a selection of beverages, the full list of the inclusive beverages is available to view at the Portbyhan Hotel Bar, Restaurant or Reception.
2.14 The card can only be used for tables of 6 or less.
LOSS, THEFT OR DAMAGE
3.1 You should immediately report any loss, theft, fraudulent or unauthorised use of your Discount Card by emailing stay@portbyhan.com
3.2 In the event of loss, theft, fraud or other unauthorised use of your Discount Card, or if your Discount Card is damaged
or malfunctions, we may, at our sole discretion, replace your Discount Card. We cannot be liable for the misuse, loss or damage of your Discount Card.
3.3 When it is authorised, we will post out a replacement Discount
Card directly to your registered address.
3.4 We reserve the right to charge a fee of 5GBP for each replacement
Discount Card.
3.5 If you subsequently find or retrieve a Discount Card which you had previously reported lost or stolen, you must notify Customer Services immediately in accordance with clause 1.4 above.
COMPLAINTS PROCEDURE
4.1 We aim to deal with all complaints as effectively and fairly as possible. If you wish to make a complaint regarding any element of the Discount Card Scheme please contact us either:

DATA PROTECTION
5.1 When purchasing the Discount Card, if you have opted in for postal or email communication, you consent to be contacted by the Portbyhan Hotel to receive marketing information applicable to Discount Card cardholders. Information regarding any personal information which you may provide to us and how we use your personal information is detailed in our Privacy Policy.
VARIATION AND CANCELLATION
6.1 If at any time you wish to cancel your Discount Card you may do so by returning your Discount Card to the Portbyhan Hotel in accordance with clause 4 above. If you cancel your Discount Card (other than under paragraph 2.10) you will not receive a refund.
6.2 We reserve the right, at any time and without notice, to: 6.2.1 amend or waive any provision of these Terms from time
to time; and/or
6.2.2 terminate the Discount Card Scheme; and/or
6.2.3 decline to issue Discount Cards; and/or
6.2.4 on reasonable grounds, withdraw or cancel Discount Cards, where reasonable grounds shall include (but not be limited to):
6.2.4.1 any abuse or attempted abuse of the scheme; and/or 6.2.4.2 any use or attempted use of a Discount Card in a manner which is contrary to these Terms; and/or
6.2.4.3 any reasonable suspicion of dishonesty we may have on your part in connection with the Discount Card Scheme.
